Fair Use Policy

This Fair Use Policy applies to MadaCell plans described as “Unlimited” and any other plan expressly stated to be subject to fair-use conditions.
Our aim is to give travellers generous, reliable mobile-data access while protecting the quality and availability of the underlying mobile networks.
1. What “Unlimited” Means
Unless the specific plan clearly states otherwise, MadaCell Unlimited plans provide:
2 GB of high-speed data per day.
After you use 2 GB of high-speed data during the applicable daily period:
Your data remains available, but your connection speed is reduced to up to 1 Mbps for the remainder of that daily period.
Your high-speed allowance then resets according to the daily reset period applicable to your plan or underlying network.
There is no additional charge simply for continuing to use data at the reduced Fair Use speed.
2. Unlimited Does Not Mean Unlimited Maximum-Speed Data
The word Unlimited refers to the ability to continue using mobile data after the high-speed allowance has been consumed, subject to this Fair Use Policy.
It does not mean unlimited data at maximum available 4G or 5G speed.
3. Plans With Different Limits
Some MadaCell Unlimited plans may include a different:

daily high-speed allowance;
-
Fair Use speed;
-
reset period;
-
hotspot allowance; or
-
network-specific restriction.
Where a product page expressly states different limits, the conditions stated for that specific plan take precedence over the standard 2 GB daily allowance described in this policy.
4. What Does “High Speed” Mean?
High-speed data means access without the Fair Use speed restriction being applied by reason of exhausting your daily high-speed allowance.
It does not guarantee a particular Mbps speed.
Actual network speeds vary according to factors such as:

local coverage;
-
network congestion;
-
signal strength;
-
network technology;
-
your device;
-
your location;
-
the local mobile operator; and
-
other technical conditions.
5. Fair Use Speed
Once your daily high-speed allowance is exhausted, the standard Fair Use speed is up to 1 Mbps, unless your particular plan states otherwise.
Actual performance at that point may be lower than 1 Mbps depending on network conditions.
The reduced-speed service is intended to allow continued general mobile-data use, but some high-bandwidth activities may be slower or may not perform effectively.
6. Daily Reset
The high-speed allowance is replenished according to the daily reset cycle applicable to the relevant plan or underlying network.
The reset is not necessarily based on the customer's local midnight unless expressly stated.
7. Hotspot and Tethering
Hotspot and tethering availability varies by plan.
Where permitted, data used through hotspot/tethering contributes to the same applicable data allowance and Fair Use thresholds unless the product specifically states otherwise.
8. Network Management
MadaCell and its underlying network partners may take reasonable steps to maintain network integrity and prevent activity that materially harms network performance or other users.
Network-management practices may vary between operators and destinations.
9. Prohibited or Abusive Use
MadaCell plans are intended for ordinary personal travel connectivity.
You must not use the service in a way that is unlawful or designed to damage, disrupt, overload or circumvent the normal operation of a telecommunications network.
Examples may include:

deliberate network attacks;
-
distribution of malware;
-
fraudulent activity;
-
unauthorised commercial resale of connectivity;

attempting to bypass technical Fair Use restrictions;

use of automated systems specifically designed to create excessive or harmful network load; or
-
other activity prohibited by law or the underlying network operator.
10. Restrictions
Where we reasonably identify unlawful, fraudulent or materially abusive use, we may restrict or suspend the affected service where necessary and proportionate.
Ordinary high data usage by itself is handled through the disclosed Fair Use speed restrictions and will not be treated as abuse merely because a customer uses their Unlimited plan heavily.
11. Transparency
We want customers to understand what they are buying.
Where a MadaCell product is advertised as Unlimited, the applicable high-speed allowance and Fair Use conditions should be made available before purchase.
If the conditions shown for your specific plan differ from this general policy, the specific product conditions apply.
